This website is governed by these Terms of Use (the “Terms“) and accompanying Privacy Statement, which is incorporated into and made part of these Terms.
These documents govern your access to and use of the SVIV website (the “Site“). These Terms constitute a binding legal agreement between you and SVIV. SVIV reserves the right to investigate and prosecute any violations of the above to the fullest extent of the law. At any time, SVIV may involve and cooperate with enforcement authorities in prosecuting users who violate these Terms. SVIV has no obligation to monitor your access to or use of the Site or Content or to review or edit any Content. However, SVIV has the right to review, edit or remove any Content for the purpose of operating the Site, to ensure your compliance with these Terms, or to comply with the law or the order or requirement of a court, administrative agency or other governmental body. Governing Law and Jurisdiction These Terms and any action related thereto shall be governed and construed in accordance with the laws of the Republic of Singapore. Any dispute arising out of or in connection with these Terms, including without limitation any questions regarding its existence, validity or termination, shall first be submitted to the Singapore Mediation Centre for resolution by mediation in accordance with the Mediation Procedure for the time being in force. The parties agree to participate in the mediation in good faith and undertake to abide by the terms of any settlement reached.
Entire Agreement These Terms, together with any amendments and any supplemental agreements you may enter into with SVIV for the use of the Site, constitute the entire understanding and agreement between SVIV and you regarding the Site and Content.
Assignment You may not assign or transfer these Terms, by operation of law or otherwise, without prior written consent from SVIV. Any attempt by you to assign or transfer these Terms, without such consent, will be void and of no effect. SVIV may assign or transfer these Terms, at its sole discretion, without restriction and without requiring your consent. Subject to the foregoing, these Terms will bind and inure to the benefit of the parties, their successors and permitted assigns.
Notices Any notices or other communications permitted or required hereunder, including those regarding modifications to these Terms, will be in writing and given by SVIV by posting the notices or updated Terms to the Site.
General The failure of SVIV to enforce any right or provision of these Terms will not constitute a waiver of future enforcement of that right or provision. The waiver of any such right or provision will be effective only if in writing and signed by a duly authorized representative of SVIV. Except as expressly set forth in these Terms, the exercise by either party of any of its remedies under these Terms will be without prejudice to its other remedies under these Terms or otherwise. If for any reason a court of competent jurisdiction finds any provision of these Terms invalid or unenforceable, that provision will be enforced to the maximum extent permissible and the other provisions of these Terms will remain in full force and effect.
Third Party Rights A person who is not a party to these Terms has no rights under the Contracts (Rights of Third Parties) Act Cap 53B to enforce any of these Terms.
Changes to Terms of Use SVIV reserves the right, at its sole discretion, to modify, discontinue or terminate the Site, or to modify these Terms, at any time and without prior notice. The modified terms will be posted on the Site along with the date when the modifications are effective. By continuing to access or use the Site after the modifications, you agree to be bound by the Terms which have been modified from time to time.
